Terms of Service

1. Acceptance of terms
By accessing or using Insite Platform (“Insite”, “the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. Insite is operated by INVESTUY S.A.S., based in Punta del Este, Uruguay. These Terms constitute a legally binding agreement between you and INVESTUY S.A.S.
2. Description of service
Insite is a SaaS customer communication platform that allows businesses to connect and manage their WhatsApp Business, Instagram, and Facebook Messenger accounts from a single dashboard. The Service enables businesses to receive and respond to customer messages, manage conversations, and communicate with their customers across multiple channels.
3. Account registration
To use Insite, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization.
4. Third-party platform connections
Insite integrates with Meta Platforms, Inc. products including WhatsApp Business Platform, Instagram, and Facebook Messenger. By connecting these accounts to Insite, you authorize us to access and process data from those accounts on your behalf in accordance with our Privacy Policy. Your use of Meta products through Insite is also subject to Meta's own terms and policies, including the WhatsApp Business Terms, Meta Platform Terms, and applicable usage policies. You are responsible for complying with those terms.
5. Acceptable use
You agree to use Insite only for lawful purposes. You must not use the Service to:
- Send unsolicited messages (spam) or violate anti-spam laws
- Harass, threaten, or harm any individual
- Violate any applicable law or regulation
- Infringe on the intellectual property rights of others
- Transmit malicious code or interfere with the Service
- Violate Meta's Platform Policies or WhatsApp Business Policy
- Send messages to individuals who have not consented to receive them
We reserve the right to suspend or terminate your account if you violate these acceptable use requirements.
6. Data and privacy
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring you have the legal right to share any data you provide to Insite, including customer contact information and message content. You retain ownership of your data. By using the Service, you grant Insite a limited license to process your data solely for the purpose of providing the Service.
7. Payment and billing
Insite offers subscription plans with fees as described on our pricing page. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in your subscription agreement. We reserve the right to change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
8. Service availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, including outages from third-party providers such as Meta Platforms.
9. Intellectual property
Insite and its original content, features, and functionality are owned by INVESTUY S.A.S. and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent.
10. Limitation of liability
To the maximum extent permitted by law, Insite and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the three months preceding the claim.
11. Termination
You may cancel your account at any time from your account settings. We reserve the right to suspend or terminate your account at any time if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our data retention policy described in the Privacy Policy.
12. Governing law
These Terms are governed by the laws of Uruguay. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Maldonado, Uruguay.
13. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
